A man was jailed for raping a teenage British vacationer in the restrooms of a nightclub on the Costa del Sol.
The man, who was not named, followed his victim to a booth in a nightclub in Malaga before raping her.
He had denied rape, claiming the teen asked him to show her where the toilets were before they had consensual sex.
Judges at the Provincial Audiencia Court in Malaga ruled that he had raped her in a written judgment released Monday after a trial earlier this year.
They also said they found out the teen told the sex attacker to stop repeatedly and sought help from a friend after the attack in July 2017.
Investigators from a specialized police unit identified the man through CCTV footage and interviews with witnesses.
After being identified by his victim, the police questioned him and insisted that they grabbed his arm and ask him to have sex in the toilet cubicle.
The convicted rapist is expected to appeal and his identity to be kept secret until the outcome is known.
The British vacationer, who testified via video link at the trial, returned to the UK immediately after the incident.
She should continue to receive counseling for the emotional trauma she has suffered.
Her attacker was jailed for six years after issuing a restraining order that prevented him from communicating with his victim for eleven years and had to pay £ 12,800 in compensation.
